The 21st Century Cures Act provides parents/guardians access to electronic records, making healthcare more transparent. This means that healthcare professionals need to carefully monitor how they take clinical notes so they do not compromise the confidentiality of LGBTQ+ youth. Nonetheless, the law allows healthcare professionals to block the online release of sensitive information and other notes that could potentially cause harm (e.g., STI testing, information outing someone). Healthcare professionals should use a confidential note template to appropriately flag information and block its online release and should use separate proxy systems for parents/caregivers and youth to access their medical records. This would allow youth to have private access to sensitive medical records and would require any patient to have special permission to access certain records over the phone. Be sure to consult with legal counsel to ensure compliance with all local/tribal, state, and federal laws.
